DATA PROTECTION
MEPHISTO S.A.S

DATA PROTECTION DECLARATION

Protecting your personal data is something we take very seriously. We want you to know when we collect data, what data we collect, and how we use it. Where data is passed on to external service providers that work for us, we have taken technical and organisational measures to ensure that the data protection regulations are observed both us and them.

COLLECTION, PROCESSING, STORAGE AND USE OF PERSONAL DATA

In the event of a contract being concluded, we collect and process your personal data provided by you in our system and use them for the duration of the processing of the contract, i.e. for order processing and billing. Personal data is any information that allows a person to be directly or indirectly identified, e.g. name, address, e-mail address, date of birth, occupation, bank account details, etc.

We create and use anonymous usage profiles for the purposes of advertising, market research and the appropriate design of our offer. Furthermore, we use the stored postal and e-mail addresses to provide you with more information about new products and products similar to your last order. On the other hand, you have the right to object at any time by making a declaration or sending an e-mail to service@mephisto.com or by clicking on the respective box on the order or the link at the end of each newsletter.

We would like to point out that, for the purpose of deciding whether to establish, execute or terminate the contractual relationship within the framework of the risk management, we collect or use probability values to determine your future behaviour, and also use address data to calculate these probability values.

We will provide you with information about your stored personal data free of charge. You may also request the correction, blocking and deletion of your personal data stored by us at any time.

We would like to point out that we have sent your address data (name, address, date of birth) to infoscore Consumer Data GmbH, Rheinstr. 99, 76532 Baden-Baden for the purpose of the creditworthiness check (and the subsequent selection of payment methods by us). From infoscore Consumer Data GmbH, we obtain information on your prior payment behaviour and creditworthiness information on the basis of mathematical-statistical methods that make use of address data.

We use your personal information for orders placed only with our company and affiliated companies, as well as with those companies charged with order processing. We do not pass your data on to third parties without your explicit consent, especially not for advertising purposes. We will transmit your data to the competent authorities as far as we are obliged to do so by law or by court order.

We store your details on specially protected servers. They are protected by technical and organisational measures against loss, destruction, access, alteration or the dissemination of your data by unauthorised persons. Access to your data is only possible for a few authorised persons. They are responsible for providing the technical, commercial or editorial support of the servers. Despite regular checks, however, complete protection against all risks is not possible.

Your personal data will be encrypted and then transmitted via the Internet. We use SSL (Secure Socket Layer) encryption for data transmission purposes.

EVALUATION OF IP ADDRESSES AND FURTHER INFORMATION

When you access our website, our servers store data, including the IP address, date, time and the pages viewed. These data may allow the identification of individual users.

We do not use the IP address to identify the user. However, we can use the recorded IP addresses for (anonymous) statistical evaluations if need be. We also use the information about your IP address and other data to prevent fraudulent use and to select the right country version of our website.

USE OF COOKIES

Cookies are used on our Internet pages. Cookies are small text files that are stored on your computer and which your Internet browser saves. Cookies are often used to make a website more user-friendly and effective. For technical reasons, they are required, for example, for the shopping basket function.

Most of the cookies we use are so-called “session cookies”, which are deleted when you end your browser session. There are also some persistent cookies, which are used to recognise you as a visitor.

Furthermore, we use the cookies to perform site usage, frequency, and marketing evaluations. In order to do so, we use the online tracking services of Google Analytics, a web analytics service provided by Google, Inc. All the information we gather about these evaluations is not personal and thus completely anonymous.

The cookies created by us can be deleted by you at any time.

Most Internet browsers are set up in such a way that they accept cookies automatically. However, you can disable the saving of cookies or set your Internet browser up so that it notifies you when cookies are sent.

USE OF GOOGLE ANALYTICS

This website uses Google Analytics, a web analytics service provided by Google, Inc. (“Google”) and Google Remarketing. Google Analytics uses so-called “cookies”, which are text files stored on your computer and which enable the website to analyse how users use the site. The information generated by the cookie about your use of the website is, as a rule, transmitted to and stored by Google on servers in the United States. In the event of the activation of the IP anonymization, however, Google will truncate your IP address within the Member States of the European Union or in other signatories to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be sent to a Google server in the USA and truncated there. On behalf of the website provider, Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity and providing further services relating to website activity and Internet usage to the website provider. Google will not associate your IP address transmitted from your browser within the framework of Google Analytics with any other data held by Google. You may refuse the use of cookies by selecting the appropriate settings on your browser. However, please note that if you do so, you may not be able to use the full functionality of this website. Furthermore, you can prevent Google’s collection and use of data relating to your use of the website (incl. your IP address) by downloading and installing the browser plug-in available under the following link https://tools.google.com/dlpage/gaoptout?hl=en-GB.

For more information on this, see http://tools.google.com/dlpage/gaoptout?hl=en or go to http://www.google.com/intl/en/analytics/privacyoverview.html (general information about Google Analytics and data protection). We would like to point out that, on this website, Google Analytics has been extended by the code “gat._anonymizeIp ();” in order to ensure the anonymous detection of IP addresses (so-called IP masking).

USE OF FACEBOOK SOCIAL PLUGINS

Our Internet site uses social plugins from the social network “facebook.com”, operated by Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA (“Facebook”). The plugins are marked with a Facebook logo or with the words “Facebook Social Plugin”. When you visit our pages, a direct connection is established via the plugin between your browser and the Facebook server. The content of the plugin is transmitted directly from Facebook to your browser and integrated into the website by it. By integrating the plugins, Facebook is given the information that you have accessed the corresponding page of our Internet site. If you are logged into Facebook, Facebook can assign the visit to your Facebook account. If you interact with the plugins, e.g. by pressing the “Like” button or leaving a comment, the corresponding information will be sent directly from your browser to Facebook and stored there. The purpose and scope of the data collection and the further processing and use of the data by Facebook, as well as your rights and settings for the protection of your privacy, can be found in the “Privacy Policy of Facebook”. FACEBOOK REMARKETING / RETARGETING

Remarketing tags of the social network Facebook (1601 South California Avenue, Palo Alto, CA 94304, USA) are integrated into the pages of our website. When you visit our website, these remarketing tags establish a direct connection between your browser and the Facebook server. This informs Facebook of your visit to our site together with your IP address. Facebook is then able to assign this visit to your user account (Custom Audiences). We subsequently use the information thus obtained for the display of Facebook Ads. We wish to point out that we, as the website providers, have no knowledge of the content of the data transmitted or of its use by Facebook. For more information, you should refer to Facebook’s privacy policy here: https://www.facebook.com/about/privacy/. If you do not wish your data to be acquired via Custom Audiences, you can disable Custom Audiences here: https://www.facebook.com/ads/website_custom_audiences.
